Contractor Terms of Use

1. Role of Building Group

1. Building Group sources and manages leads for a wide range of building and construction work ("Leads").
2. Building Group may allocate or nominate Leads and jobs to you as a contractor (and to your sub‑contractors, where applicable).

2. Commission and Fees

1. For each job that you win as a result of a Lead provided by Building Group, you agree to pay Building Group a commission fee (the "Commission"). The Commission percentage is agreed between you and Building Group in advance.
2. The Commission becomes due and payable in full immediately once you win the job (i.e. when the customer instructs you to proceed, signs a contract, or pays a deposit, whichever happens first).
3. You must pay all Commission in full and on time. If the Commission is not paid:
   • (a) Building Group may contact the customer directly to recover any sums due or to confirm the status and value of the job; and/or
   • (b) Building Group may take legal action to recover unpaid Commission, including seeking a winding‑up order or other enforcement action against your business.
4. If you win a job from a Lead supplied by Building Group and you do not notify Building Group, or you attempt to avoid paying Commission:
   • (a) the Commission rate for that job automatically increases to 10% of the contract value; and
   • (b) Building Group may pursue full recovery of that 10% plus any reasonable legal and collection costs, including by way of a winding‑up order or other enforcement action.

3. Sub‑Contracting

1. You may sub‑contract all or part of a job to another trade or sub‑contractor, provided that:
   • (a) you remain responsible to Building Group for payment of the Commission; and
   • (b) Building Group still receives the full Commission due on the job.
2. You are responsible for ensuring that any sub‑contractors you use comply with these Terms where relevant.

4. Lead Handling and Response Times

1. You must make reasonable efforts to contact every Lead that Building Group allocates or nominates to you on the same business day you receive the Lead details.
2. If you do not attempt to contact a Lead on the same business day, you will be in breach of these Terms and Building Group may:
   • (a) re‑allocate that Lead to another contractor; and/or
   • (b) reassess, suspend, or terminate your partnership and access to further Leads from Building Group.
3. You must keep your contact details (phone and email) up‑to‑date so you can be reached promptly about new Leads and jobs.

5. Conduct and Compliance

1. You agree to carry out all work professionally, safely, and in accordance with all applicable laws, regulations, and industry standards.
2. All contracts for building works are between you (or your business) and the customer. Building Group is not a party to those contracts and is not responsible for the quality, safety, or completion of any work.
3. You must maintain appropriate insurance (including public liability insurance and any other legally required cover) for the work you carry out.

6. Termination and Suspension

1. Building Group may suspend or terminate your access to Leads and to this contractor portal at any time if you:
   • fail to pay Commission when due;
   • breach these Terms (including lead response obligations); or
   • act in a way that, in Building Group’s reasonable opinion, damages or risks damaging our reputation or customer relationships.
2. Termination does not affect any Commission already due and payable to Building Group, which remains fully collectible.

7. Data and Communication

1. You consent to Building Group contacting you by phone, SMS, email, or through this portal in relation to Leads, jobs, invoices, and Commission.
2. You consent to Building Group contacting customers where necessary to: verify job status and value, resolve disputes, or recover unpaid Commission.

8. Changes to These Terms

1. Building Group may update these Terms from time to time. Where changes are material, you may be asked to accept the new version in this portal before receiving further Leads.
2. The current version of these Terms is identified below as the Terms Version.
